Fracking Companies: Property Damage Case Should Be Dismissed With Prejudice

Mealey's (June 18, 2015, 4:22 PM EDT) -- LITTLE ROCK, Ark. — Hydraulic fracturing companies that have been sued by residents who contend that their properties have been damaged as a result of fracking waste disposal in injection wells on Sept. 9, 2014, filed a brief in Arkansas federal court contending that the putative class action against them should be dismissed with prejudice on grounds that the plaintiffs have failed to prove their claims. The companies also contend that the plaintiffs should not be permitted to voluntarily dismiss their case without prejudice, which would allow them to relitigate the issue (Bobbie Hill, et al. v.
