New York Appeals Court: Cigarette Tax On Sales To Non-Indians Not Barred
(June 14, 2016, 9:46 AM EDT) -- ROCHESTER, N.Y. — A New York appeals court on June 10 reaffirmed that while a treaty with an Indian tribe and Indian law bar the taxation of reservation land, they do not block the imposition of sales taxes on cigarettes sold on reservations to non-Indians (Eric White, et al v. Eric T. Schneiderman, et al., No. 448 CA 15-01764, N.Y. Sup., App. Div., 4th Dept.).
