Agencies: Venue Transfer For PFAS Case Proper, Jurisdiction For Appeal Is Lacking

Mealey's (January 24, 2023, 1:34 PM EST) -- WASHINGTON, D.C. — On Jan. 23, federal agencies filed a brief in the District of Columbia Circuit U.S. Court of Appeals opposing a request for a temporary restraining order (TRO) by a man who is appealing a decision to transfer venue of his lawsuit against the government over exposure to per- and polyfluoroalkyl substances (PFAS) related to a proposal to build an offshore wind farm. The agencies say jurisdiction is lacking and the denial of a TRO is not immediately appealable....
