Mealey's (January 17, 2023, 1:45 PM EST) -- CINCINNATI — A split Sixth Circuit U.S. Court of Appeals panel on Jan. 13 upheld a ruling on interlocutory appeal, with the majority saying in part that Ohio’s “all-sums” allocation doctrine “doesn’t absolve the insured of all financial burden” and the dissenter calling it “a defining feature” of the doctrine “that uninsured or self-insured parties are not held responsible for their pro rata share of the liability in continuous injury cases.”...
