Judge: Failure-To-Update Generic Drug Label Claim OK, But Causation Is Lacking
(May 2, 2016, 1:54 PM EDT) -- BIRMINGHAM, Ala. — An Alabama federal judge on April 29 said a Reglan/metoclopramide plaintiff’s claim that generic drug maker/defendants failed to update their warning labels is not preempted, but said the plaintiff failed to show that the outdated labels caused her tardive dyskinesia (Linda Woods v. Wyeth, LLC, et al., No. 13-543, N.D. Ala., Southern Div.; 2016 U.S. Dist. LEXIS 57181).
