11th Circuit Panel Reinstates Borrower’s Claims Of Wrongful Foreclosure
(May 2, 2016, 7:25 AM EDT) -- ATLANTA — An 11th Circuit U.S. Court of Appeals panel on April 22 reversed dismissal of a lawsuit brought by a homeowner who claimed that her lender’s failure to timely request postponement of the foreclosure following a negotiated loan-modification agreement caused her to be wrongfully foreclosed on (Arelis Nunez v. J.P. Morgan Chase Bank, N.A., et al., No. 15-12188, 11th Cir.; 2016 U.S. App. LEXIS 7279).
