California Appeals Court Says State Must Be Notified Of Any Water Diversion

Mealey's (June 18, 2015, 12:53 PM EDT) -- SACRAMENTO, Calif. — A California appeals court on June 4 said the state Fish and Game Code is not ambiguous as to what constitutes a substantial diversion of water and said a county farm bureau is required to notify the state Department of Fish and Wildlife about water diversions of any size (Siskiyou County Farm Bureau v. Department of Fish and Wildlife, No. C073735, Calif. App., 3rd Dist.; 2015 Cal. App. LEXIS 485).
