Virginia Federal Judge Dismisses ERISA Action, Says Plaintiff Not Co-Fiduciary
(April 25, 2016, 8:33 AM EDT) -- ALEXANDRIA, Va. — Allegations that an employer interfered with a plaintiff’s purported right to remedy noncompliance with the Employee Retirement Income Security Act were dismissed April 8 by a Virginia federal judge, who found that the plaintiff failed to establish her status as a co-fiduciary to the ERISA plans at issue (Rose Paasch v. National Rural Electric Cooperative Association, No. 15-1638, E.D. Va.; 2016 U.S. Dist. LEXIS 5261).
