Mealey's (May 12, 2022, 1:38 PM EDT) -- WASHINGTON D.C. — In a May 11 amicus curiae brief, filed at the U.S. Supreme Court’s request, the U.S. Solicitor General (SG), on behalf of the United States, says a petition for certiorari questioning whether the Seventh Amendment to the U.S. Constitution was violated by the Federal Circuit U.S. Court of Appeals’ setting aside of a patent infringement verdict and construction of a disputed claim term should be denied, with the government opining that instead of clearing up “purported lower-court confusion regarding” Markman v. Westview Instruments, Inc., the arguments presented by the petitioner “would introduce rather than alleviate uncertainty.”...
