Company: Insurer Owes Duty To Defend In Lawsuit Filed By State Of West Virginia
(April 13, 2016, 10:53 AM EDT) -- CHICAGO — A pharmaceutical company filed a brief in the Seventh Circuit U.S. Court of Appeals on March 11 contending that a district court erred when it ruled that the company’s insurer did not have a duty to defend it against an economic damages lawsuit filed by the State of West Virginia, which claims that the pharmaceutical company overdistributed drugs and caused people to become addicted (Cincinnati Insurance Company v. H.D. Smith LLC, No. 15-2825, 7th Cir.).
