Pennsylvania Board: Township Must Provide Discovery In Fracking Permit Dispute

Mealey's (June 18, 2015, 10:51 AM EDT) -- HARRISBURG, Pa. — The Pennsylvania Environmental Hearing Board (EHB) on April 27 overruled a local municipality’s objections to discovery requests filed by the Pennsylvania Department of Environmental Protection (DEP) in a hydraulic fracturing permit dispute, but denied the DEP’s motion to dismiss the municipality’s case challenging the issuance of the permit itself (South Fayette Township v. Commonwealth of Pennsylvania Department of Environmental Protection, No. 2014-071-R, Pa. EHB).
