Abbott’s Knowledge Of Risks Of Depakote Enough For Punitive Damages, Judge Says
(April 11, 2016, 2:42 PM EDT) -- ST. LOUIS — A Missouri federal judge on April 8 denied a motion to excluded a punitive damages claim in a May 23 Depakote birth defect trial, saying the plaintiff has presented evidence that defendant Abbott Laboratories Inc. may have known that the drug could cause birth defects (B.F., et al. v. Abbott Laboratories, Inc., et al., No. 12-1760, E.D. Mo., Eastern Div.; 2016 U.S. Dist. LEXIS 47618).
