Ohio Judge: City’s Ban On Fracking Preempted By State Regulatory Scheme

Mealey's (June 18, 2015, 10:23 AM EDT) -- CLEVELAND — An Ohio state court judge on March 10 ruled that a local municipality’s ban on new and expanded hydraulic fracturing is preempted by state law, which grants the Ohio Department of Natural Resources (ODNR) exclusive authority to issue permits for fracking (Bass Energy Inc. v. City of Broadview Heights, Ohio, No. 14-828074, Ohio Comm. Pls., Cuyahoga Co.).
