California Federal Judge Partially Dismisses Pre-Foreclosure Claims
Mealey's (April 5, 2016, 9:33 PM EDT) -- SAN FRANCISCO — A California federal judge on March 17 partially granted and partially denied motions to dismiss claims challenging various entities’ authority to initiate a foreclosure in light of the original assignee’s transfer of the deed of trust (DOT) to another entity before its assets were subsequently acquired (John F. Lundy v. Selene Finance, LP, et al., No. 15-5676, N.D. Calif.; 2016 U.S. Dist. LEXIS 35547).
