Judge: State Insurance Guarantor’s Statute Is Preempted By Federal Law
(March 24, 2016, 10:21 AM EDT) -- LOS ANGELES — A federal judge in California on March 16 granted the United States’ motion to dismiss portions of California’s insurance guarantor’ complaint regarding Medicare payments, holding that California’s insurance codes are preempted by federal law (California Insurance Guarantee Association v. Sylvia Mathews Burwell, et al., No. 15-cv-1113, C.D. Calif.; 2016 U.S. Dist. LEXIS 34163).
