Federal Judge Denies Motion To Reopen Appeal, Says Court Open Amid COVID Pandemic

Mealey's (November 18, 2021, 7:22 AM EST) -- GREENBELT, Md. — On remand from the Fourth Circuit U.S. Court of Appeals, a federal judge in Maryland on Nov. 3 denied a pro se plaintiff’s request to reopen or extend the time to appeal the dismissal of his complaint, rejecting the plaintiff’s argument that his notice of appeal, filed after the filing deadline, was actually timely because the district court was closed to the public because of the COVID-19 pandemic.  The judge found that the court remained open for litigant filing and that the plaintiff did not request an extension of the filing deadline; the plaintiff on Nov. 5 moved for reconsideration....
