Judge Partially Dismisses Tainted Groundwater Case; Negligence Claim Stands

Mealey's (June 17, 2015, 4:31 PM EDT) -- HARRISBURG, Pa. — The Pennsylvania federal judge presiding over a groundwater contamination lawsuit related to hydraulic fracturing operations by two drilling companies on Jan. 12 adopted a magistrate judge’s recommendation and granted summary judgment to one of the defendants, but denied it to the other, holding that claims for private nuisance and negligence stand (Nolen Scott Ely v. Hon. Martin C. Carlson Cabot Oil & Gas Corporation, et al., No. 09-2284, M.D. Pa.; 2015 U.S. Dist. LEXIS 3106).
