‘Water Rights Doctrine’ Does Not Require Federal Funds For New Tribal Water Source

Mealey's (June 17, 2015, 1:52 PM EDT) -- WASHINGTON, D.C. — The federal government is under no obligation under any federal law or case law, including the so-called water rights doctrine, to pay the Hope Tribe of Arizona for a new, uncontaminated water supply, the Federal Circuit Court of Appeals ruled April 2 (The Hopi Tribe, et al. v. United States, No. 14-5018, Fed. Cir.; 2015 U.S. App. LEXIS 5283).
