9 States Urge 11th Circuit To Apply Its Case Law In Clean Water Rule Appeal
(February 25, 2016, 2:55 PM EST) -- ATLANTA — Nine states on Feb. 23 told the 11th Circuit Court of Appeals that it should hear the states’ challenge of the Clean Water Rule because the court’s own case law rejected the rationale cited Feb. 22 by the Sixth Circuit in finding that jurisdiction in Clean Water Rule cases belong in federal appeals courts (State of Georgia v. McCarthy, No. 15-14035, 11th Cir.).
