U.S. Supreme Court Declines Takings Case Related To State Fracking Moratorium

Mealey's (June 1, 2021, 10:11 AM EDT) -- WASHINGTON, D.C. — The U.S. Supreme Court on June 1 refused to hear a hydraulic fracturing company’s petition in which it argued that Illinois Department of Natural Resources should not be allowed to “concoct or devise a regulatory scheme designed to take property” and avoid “just compensation” for that taking in violation of the Fifth Amendment to the U.S. Constitution.  The company insisted that the state’s “unauthorized moratorium on permits” and “onerous regulations” amount to “a categorical regulatory taking” of fracking leases....
