U.S. Tells High Court That FCRA Violations Caused Concrete Injury

Mealey's (February 17, 2021, 4:12 PM EST) -- WASHINGTON, D.C. — The United States filed an amicus brief on Feb. 8 in support of neither side in a class lawsuit before the U.S. Supreme Court concerning whether a violation of the Fair Credit Reporting Act (FCRA) alone proves Article III of the U.S. Constitution injury or a “certainly impending” injury, arguing that a “violation of FCRA’s reasonable-procedures required caused all class members to suffer a concrete and particularized Article II injury-in-fact” but asking that the judgment for the class be vacated and remanded for reconsideration of class certification in light of the class representative’s “atypical injuries.”...
