Split 10th Circuit: NLRB May Disregard Interim Earnings In Back-Pay Calculation
(February 11, 2016, 10:42 AM EST) -- DENVER — A split 10th Circuit U.S. Court of Appeals panel on Jan. 20 upheld a decision by the National Labor Relations Board to disregard interim earnings made by full-time workers who picked up second jobs while their hours were reduced when calculating a back-pay award (National Labor Relations Board v. Community Health Services, Inc., d/b/a Mimbres Memorial Hospital and Nursing Home, No. 14-9614, 10th Cir.; 2016 U.S. App. LEXIS 905).
