Divided 4th Circuit Panel Upholds Ruling For Employer On Retaliation, Bias Claims
(February 11, 2016, 10:31 AM EST) -- RICHMOND, Va. — A divided Fourth Circuit U.S. Court of Appeals panel on Jan. 21 affirmed a trial court’s ruling in favor of an employer on a mine worker’s retaliation and disability claims, finding that the employer presented sufficient evidence of nondiscriminatory reasons for terminating the worker after she was injured while working (Joyce Anderson v. Consolidation Coal Company, et al., No. 14-2048, 4th Cir.; 2016 U.S. App. LEXIS 1011).
