Judge Must Consider Medicare’s ‘Systemic Failure,’ Federal Appeals Court Says

(February 10, 2016, 3:38 PM EST) -- WASHINGTON, D.C. — On remand, a district court must consider whether the “systemic failure” in the Medicare appeals process warrants mandamus relief, a District of Columbia Circuit U.S. Court of Appeals panel held Feb. 9 in reversing dismissal of the case (American Hospital Association, et al. v. Sylvia Mathews Burwell, et al., No. 15-5015, D.C. Cir.).
