7th Circuit Reinstates USERRA Class Claims Seeking Paid Leave

Mealey's (February 9, 2021, 12:49 PM EST) -- CHICAGO — A commercial pilot who accuses his employer of violating the Uniformed Services Employee and Reemployment Rights Act (USERRA) by providing short-term paid leave of employees who are sick or out for jury duty but denying pay to reservists who take short-term leave for military service may proceed with his class claims as paid leave falls within the statute’s “rights and benefits,” a Seventh Circuit U.S. Court of Appeals panel ruled Feb. 3 in a matter it noted was one of first impression, reversing the trial court’s judgment and writing that the “case was ended prematurely.”...
