Judge Says Environmentalists’ Grazing Lawsuit Is An Administrative Appeal

Mealey's (June 17, 2015, 11:41 AM EDT) -- LAS CRUCES, N.M. — A New Mexico federal judge on April 20 said an environmental group’s challenge of livestock grazing decisions by federal agencies must proceed under the Administrative Procedure Act and not the citizen-suit provision of the Endangered Species Act (San Diego Cattlemen’s Cooperative Association, et al. v. Tom Vilsack, et al., No. 14-818, WildEarth Guardians v. United States Forest Services, et al., No. 14-887, D. N.M.).
