Kentucky Appeals Court Upholds Verdict Against Property Owner In Negligence Suit
(February 6, 2016, 10:45 AM EST) -- FRANKFORT, Ky. — A corporate entity that owns several rental properties, including one where an individual performing maintenance was severely injured, had a duty under the Kentucky Occupational Safety and Health Act (KOSHA) to ensure the individual’s safety, the Kentucky Court of Appeals ruled Jan. 29, upholding a jury verdict in favor of the injured party (Auslander Properties, LLC v. Joseph Herman Nalley, et al., No. 2014-CA-000022-MR, Ky. App.; 2016 Ky. App. LEXIS 10).
