MDL Judge Denies Majority Of Rust-Oleum’s Motion To Dismiss Class Claims

(February 4, 2016, 9:51 AM EST) -- CHICAGO — The federal judge in Illinois presiding over lawsuits claiming that Rust-Oleum Corp.’s Restore 10X concrete and deck resurfacing paint is defective because it prematurely bubbles, flakes and peels on Jan. 7 denied a majority of the manufacturer’s motion to dismiss claims brought by 40 consumers from 27 states, finding that they sufficiently stated most of their claims for fraud, false advertising and violation of consumer protection laws (In re: Rust-Oleum Restore Marketing, Sales Practices and Products Liability Litigation, MDL 2602, Case No. 15 C 1364, N.D.
