LOUIS — The Eighth Circuit U.S. Court of Appeals on Jan. 29 upheld a $5 million fine against the operator of a pari-mutuel betting business at a Native American casino after finding that the operator cannot avoid liability for violations of the Indian Gaming Regulatory Act (IGRA) by claiming a lack of scienter (Bettor Racing, Inc., et al. v.
