Lipitor MDL Cases Face Summary Judgment Based On Court’s Criteria
(January 26, 2016, 2:27 PM EST) -- CHARLESTON, S.C. — The July trial date for the first Lipitor diabetes bellwether case was vacated Jan. 25 after plaintiff attorneys said that the only plaintiffs meeting the court’s criteria had disqualifying coronary artery disease and that no other MDL cases can survive summary judgment under the criteria (In Re: Lipitor [Atorvastatin Calcium] Marketing, Sales Practices and Products Liability Litigation, MDL Docket No. 2502, No. 14-mn-2502, D. S.C., Charleston Div.).
