Federal Judge Dismisses Suit For Failure To Exhaust Tribal Remedies

Mealey's (June 17, 2015, 10:19 AM EDT) -- GREAT FALLS, Mont. — A Montana federal judge on April 24 dismissed a case brought by an electric company against members of its cooperative, saying it is not apparent that the Blackfeet Tribal Court “plainly” lacks jurisdiction over the members’ underlying suit for breaches of fiduciary duty brought in the tribal court (Glacier Electric Cooperative Inc., et al. v. Floy “Bob” Gervais, et al., No. 14-75, D. Mont.).
