Federal Judge Dismisses Drug Suit For Failure To Exhaust Tribal Remedies

Mealey's (June 17, 2015, 10:19 AM EDT) -- GREAT FALLS, Mont. — Saying it is not apparent that the Blackfeet Tribal Court “plainly” lacks jurisdiction over a resident’s suit against the makers and sellers of a diabetes drug for allegedly causing his bladder cancer, a federal judge in Montana on April 24 dismissed the manufacture’s countersuit against the resident for failure to exhaust tribal court remedies (Takeda Pharmaceuticals America, et al. v. Victory Connelly, No. 14-50, D. Mont.).
