Judge: Private Right Of Action Under Federal Law Absent, Lead Paint Case Dismissed

Mealey's (August 12, 2020, 2:03 PM EDT) -- FORT WAYNE, Ind. — A federal judge in Indiana on Aug. 11 dismissed a couple's claim for negligence against a contractor they say is liable for the lead poisoning of their son on grounds that the Toxic Substances Control Act "provides no private action for compensatory damages such as those the couple requested."  The judge gave the couple permission to amend the complaint, however (Grant Matlock, et al. v.
