N.J. Bill Requiring Severance Is Preempted By ERISA, Nonprofit Association Says

(August 10, 2020, 11:30 AM EDT) -- TRENTON, N.J. — A New Jersey Senate bill requiring employers to pay severance to employees who are part of a "mass layoff" is preempted by the Employee Retirement Income Security Act because the amendments in the bill "relate to" an ERISA plan, a nonprofit trade association that represents the interest of employers that sponsor health, retirement and other benefit plans governed by ERISA says in an Aug. 6 complaint filed in New Jersey federal court (The ERISA Industry Committee v.
