Florida Court Upholds Dismissal Of Untimely Consortium Claims In Brain Injury Suit

Mealey's (July 29, 2020, 1:31 PM EDT) -- MIAMI — A trial court properly dismissed loss of consortium claims brought by the children of a woman alleging that the late diagnosis of her blood vessel disorder resulted in several strokes, a Florida appeals court held July 22.  It concluded that the claims asserted a new cause of action by new parties that were untimely filed in an amended complaint (Stacey Castro, et al. v.
