5th Circuit Remands Contractual Subrogation Issue In Quiet Title Case

Mealey's (July 27, 2020, 2:02 PM EDT) -- NEW ORLEANS— The Fifth Circuit U.S. Court of Appeals on July 22 denied the Federal Home Loan Mortgage Corp.'s (Freddie Mac) request for en banc review of its May 27 ruling that held that the lender could seek equitable subrogation on a woman's quiet title claim even though it failed to correct a curable defect in the loan documents under the Texas Constitution, amended its earlier opinion and told a federal judge in Texas to determine if the lender could also seek contractual subrogation following a ruling by the Texas Supreme Court (Sylvia Zepeda v.
