Pennsylvania High Court Affirms Wife's Promise To Waive Pension Benefits Enforceable

(July 23, 2020, 11:04 AM EDT) -- HARRISBURG, Pa. — The Pennsylvania Supreme Court, in what it deemed a case of first impression, on July 21 affirmed that while the Pennsylvania Municipal Retirement System (PMRS) could not legally divert a deceased police officer's pension benefits to his brother, his wife's promise to waive her rights to those benefits, including to transfer them after receiving them from the plan administrator, is legally enforceable (Estate of Michael A.
