9th Circuit Upholds Federal Foreclosure Bar’s Application In Quiet Title Suit

(July 20, 2020, 5:45 PM EDT) -- SAN FRANCISCO — A Ninth Circuit U.S. Court of Appeals panel on July 10 upheld a loan servicer’s summary judgment award in a quiet title action brought against the purchasers of a property at a nonjudicial foreclosure sale, finding that a federal judge in Nevada properly found that the federal foreclosure bar, which is part of the Housing and Economic Recovery Act (HERA),  was applicable because the loan servicer was an agent of the Federal National Mortgage Association (Fannie Mae) and that Fannie Mae did not consent to the sale of the property (Nationstar Mortgage LLC v.
