Medical Malpractice, Product Liability Suit Remanded, Not Severed

Mealey's (January 12, 2016, 12:31 PM EST) -- ALEXANDRIA, Va. — A federal judge in Virginia on Dec. 29 remanded a product liability and medical malpractice case involving the alleged incorrect use of a medical device during a spinal fusion surgery because there is no necessary federal question (Scott T. Carmine v. Glen Jeffrey Poffenbarger, MD, et al., No. 1:15-cv-1207, E.D. Va.; 2015 U.S. Dist. LEXIS172735).
