5th Circuit To Decide If Doctor Exhausted Administrative Remedies

Mealey's (January 12, 2016, 7:39 AM EST) -- NEW ORLEANS — A federal court erred when it dismissed bad faith claims by a surgeon seeking disability benefits from his insurers after finding that the surgeon had not effectively exhausted his administrative remedies, the surgeon recently told the Fifth Circuit U.S. Court of Appeals (James L. Moss v. Unum Group, et al., No. 15-30341, 5th Cir.).
