Opt-Out Plaintiff Cannot Amend Debt Collection Suit To Add Class Claims

(May 31, 2020, 9:36 AM EDT) -- WEST PALM BEACH, Fla. — A federal judge in Florida on May 8 denied a woman’s request to amend her lawsuit claiming that a loan servicer violated the Fair Debt Collection Practices Act (FDCPA) when charging her additional fees for making payments online or over the phone to make it a class action suit, holding that she is an opt-out plaintiff from a similar class action lawsuit and that she is allowed to bring claims only on her own behalf (Antoinette Fusco, et al. v.
