Federal Judge Orders ‘New-Hire Remedy’ For Rehired Workers In Xerox Pension Benefit Dispute
Mealey's (January 11, 2016, 10:41 AM EST) -- ROCHESTER, N.Y. — A federal judge in New York on Jan. 5 ruled on remand that an equitable remedy of reformation of contract was appropriate to remedy Xerox’s violation of the notice requirements of the Employee Retirement Income Security Act when it applied an offset to pension benefits of rehired workers (Paul J. Frommert, et al. v. Lawrence Becker, et al., No. 00-6311, W.D. N.Y.; 2016 U.S. Dist. LEXIS 439).
