Federal Judge Says Claimant Was Not Totally Disabled Under Terms Of Policy
Mealey's (January 8, 2016, 12:51 PM EST) -- CHARLESTON, S.C. — A South Carolina federal judge on Dec. 7 denied a disability claimant’s motion for summary judgment after determining that the claimant was not totally disabled under the policy at issue because she was still able to perform occupational duties that constituted 50 percent of her income (Roberta Karnofsky v. Massachusetts Mutual Life Insurance Co., No. 14-949, D. S.C.; 2015 U.S. Dist. LEXIS 163404).
