Federal Judge Tosses ‘Happy Cows’ Claims Against Ben & Jerry’s, Unilever

Mealey's (May 8, 2020, 1:53 PM EDT) -- BURLINGTON, Vt. — A federal judge in Vermont on May 7 dismissed a putative class complaint alleging that customers were being misled when Ben & Jerry’s Homemade Inc., known as a socially conscious Vermont-based company, continued to make claims that its milk and cream are sourced from Vermont’s “happy cows” even after the ice cream company was acquired by a multinational company, writing that the plaintiff failed to show that the statement was misleading or that customers “would make their purchasing decisions exclusively based on a single phrase in a single webpage heading” (James Ehlers, et al. v.
