(January 7, 2016, 3:19 PM EST) -- AUSTIN, Texas — A trial judge did not err in allowing ballistics evidence from an expert witness without first granting a requested hearing on the admissibility of the evidence, a Texas appeals panel affirmed Jan. 6 (Clifton Sivad Montague v. The State of Texas, No. 03-14-00266-CR, Texas App., 3rd Dist.; 2016 Tex. App. LEXIS 38).
