Judge Grants Facilities Limited Stay From HHS Long-Term Care Arbitration Rule

Mealey's (May 1, 2020, 3:26 PM EDT) -- FAYETTEVILLE, Ark. — In recognition of the novel coronavirus epidemic, a federal judge in Arkansas on April 30 stayed enforcement of his judgment upholding the U.S. Department of Health and Human Services (HHS) final rule for Medicare and Medicaid requirements for long-term care (LTC) facilities that places conditions on the use of arbitration agreements for 60 days, but the judge denied the plaintiff facilities’ motion for a stay pending appeal, finding that they were unlikely to succeed on the merits of their appeal or to experience irreparable harm in complying with the rule (Northport Health Services of Arkansas, LLC, et al. v.
