Claimant Worked Full Time During Elimination Period; No Benefits Due, Panel Says
(January 7, 2016, 2:37 PM EST) -- NEW YORK — A disability insurer did not arbitrarily and capriciously deny a claim for disability benefits because the claimant did not satisfy the plan’s requirements as he continued to work full time during the applicable elimination period, the Second District U.S. Court of Appeals affirmed Dec. 18 (Jeffrey Sobhani v. Reliance Standard Life Insurance Co., No. 14-3430, 2nd Cir.; 2015 U.S. App. LEXIS 22041).
