Mealey's (April 20, 2020, 7:37 AM EDT) -- NEW YORK — A Second Circuit U.S. Court of Appeals panel on April 2 reversed a district court’s confirmation of a $1.3 million arbitral award in a solar panel contract dispute against a party that was a nonsignatory to the contract and remanded with instructions to dismiss the case against the company, holding that the lower court erred in determining that the company was bound to the arbitration provision in the contract based on an agency theory and under the direct benefits theory of estoppel (Trina Solar US, Inc. v.
