4th Circuit Finds Property Owners Lacked Standing To Challenge Sale
(January 4, 2016, 12:05 PM EST) -- RICHMOND, Va. — The Fourth Circuit U.S. Court of Appeals on Dec. 28 affirmed a district court's decision to dismiss claims asserted against a bank, finding that former homeowners lacked standing to challenge the foreclosure of their property (Sostenes Pena, et al. v. HSBC Bank USA, National Association as Trustee for Deutsche Alt-A Securities Mortgage Loan Trust, Series 2007-0A2, et al., No. 14-2329, 4th Cir.; 2015 U.S. App. LEXIS 22700).
