New Jersey Panel Affirms Dismissal Of Nursing Home Suit, Compelling Of Arbitration

(March 4, 2020, 1:41 PM EST) -- TRENTON, N.J. — A trial court did not err in dismissing a negligence and wrongful death complaint against a nursing home and compelling arbitration, a New Jersey appellate panel ruled in a March 3 unpublished per curiam opinion, agreeing with the lower court that the decedent’s daughter had authority to sign the arbitration agreement and finding that the nursing home did not waive its right to arbitrate by failing to seek arbitration after receiving notices from the counsel for the estate (Estate of Evelyn Greenstein v.
